These General Terms and Conditions of Sale (hereinafter “Terms”) apply to all orders placed on the website sixwood.fr, operated by Six Holding, SAS, with registered offices at 13 rue Pasteur, 78800 Houilles, France, registered with the RCS of Versailles under number 52505238700012.

1. Purpose

These Terms define the rights and obligations of the parties regarding the online sale of products offered by SixWood to the customer. Any order implies the unreserved acceptance of these Terms.

2. Products

The products offered are described and presented with the greatest possible accuracy. Product photographs are non-contractual, particularly regarding wood grain, shades, and textures, which may vary naturally from one product to another. Each product is unique, which is an integral part of its artisanal value.

3. Pricing

Prices are indicated in Euros, inclusive of all taxes (TTC). Shipping costs are indicated separately during the checkout process. SixWood reserves the right to modify its prices at any time, but products will be invoiced based on the rates in effect at the time of the order.

4. Orders

The customer confirms their order by following the online payment process. Any order implies acceptance of the prices and descriptions of the products available for sale. The order confirmation sent by email serves as proof of the transaction.

5. Payment

Payment is made online by credit card, PayPal, or any other method offered on the site. Payment is due immediately upon ordering. Payments are secured through solutions compliant with current standards (e.g., SSL, 3D Secure).

6. Delivery

Products are shipped to the address indicated by the customer during the order process. Delivery times are provided as estimates. SixWood cannot be held responsible for delays attributable to the carrier. Shipping costs and estimated times are specified at checkout. The risk of loss or damage is transferred to the customer upon receipt of the package.

7. Right of Withdrawal

In accordance with Articles L.221-18 et seq. of the French Consumer Code:

  • The customer has a 14-day period, which we extend to 30 calendar days from the receipt of the product, to exercise their right of withdrawal.
  • The product must be returned in its original condition, complete, factory reset, and in its original packaging.
  • Return shipping costs are the responsibility of the customer.
  • Refunds will be processed within 14 business days following the receipt and inspection of the product.
  • Exception: Personalized products (engravings, inlays, or patterns provided by the customer) are neither returnable nor exchangeable, except in cases of non-conformity or prior agreement.

8. Statutory Warranties

All products benefit from the legal warranty of conformity (Articles L.217-3 et seq. of the Consumer Code), valid for 2 years from delivery. They also benefit from the legal warranty against hidden defects (Articles 1641 et seq. of the Civil Code). In the event of a defect, the customer may request repair, replacement, or a refund of the product at no additional cost.

9. Specific Return Policy

Outside the right of withdrawal, returns are only accepted in the following cases:

  • Obvious visual defects (scratches, cracks, stains, unnatural discoloration).
  • Computer malfunction. The following are not considered defects:
  • Variations in shade, grain, or wood texture inherent to its nature.
  • Personal aesthetic preferences. Returns must be pre-validated by our customer service at contact [at] sixwood [point] fr.

10. Liability

SixWood cannot be held liable in the event of misuse, intentional damage, or accidental damage to the products by the customer. SixWood’s liability is limited to the amount of the order.

11. Intellectual Property

All site content (text, images, logos, videos, graphic designs, and products) remains the exclusive property of SixWood. Any reproduction, exploitation, or distribution without prior authorization is strictly prohibited.

12. Designs and Files Provided by the Customer

When the customer provides a design, logo, text, image, or any other file for personalization:

  • The customer declares that they hold the necessary rights (copyright, trademark rights, image rights, etc.) or have obtained all required authorizations.
  • The customer guarantees SixWood against any claim, action, or lawsuit related to the use of the provided design or file.
  • SixWood declines all responsibility in the event of a violation of third-party rights resulting from the use of elements provided by the customer.

13. Personal Data

Personal data collected is necessary for order processing and customer relationship management. It is processed in accordance with the GDPR and is never transferred to third parties without consent. The customer has the right to access, rectify, and delete their data (contact: contact [at] sixwood [point] fr).

14. Force Majeure

SixWood cannot be held responsible for the non-performance or delay in the performance of an obligation due to an event of force majeure as defined by French case law.

15. Disputes and Applicable Law

These Terms are governed by French law. In the event of a dispute, the customer is invited to contact customer service to find an amicable solution. In accordance with Article L.612-1 of the Consumer Code, the customer may use a consumer mediator free of charge. Failing an amicable agreement, the French courts shall have exclusive jurisdiction.
